Terms of Service

These terms govern your use of the BarnsleyTaxis passenger app, the BarnsleyTaxis Driver app, our website and our telephone booking line (together, the "Service"). By creating an account or booking a journey you agree to these terms. Please also read our Privacy Policy.

1. Who we are

We are a licensed private-hire operator in Barnsley. All journeys are private-hire bookings pre-arranged through us — this is not a taxi-rank or street-hail service.

2. What the Service is — our role

We arrange bookings; we do not provide the journey. BarnsleyTaxis acts as a disclosed agent that connects passengers with self-employed, licensed private-hire drivers. The driver contracts directly with the passenger to carry out the journey and is responsible for it. We are not the carrier and are not a party to the transport contract between passenger and driver.

Bookings can be made through the app or by telephone; both feed the same pool of licensed drivers.

3. How pricing works (reverse bidding)

The Service uses a name-your-fare model:

The fare is agreed between the passenger and the driver before the journey. We do not set fares. Distance and time figures shown in the app are estimates to help you decide and are not a quote from us.

7. Commission and the driver wallet

Drivers pay the Operator a commission for the booking service. Commission is a percentage of the agreed fare and is drawn from the driver's wallet when a journey is completed.

The wallet is prepaid credit for our booking service — it is not money we hold on the driver's behalf, and it is not the fare. The fare is the driver's own money and does not pass through us. Wallet top-ups are made through our website and buy access to the booking service only.

Where a passenger confirms a completed ride that the driver did not close, the commission may be held pending (in "suspense") while any query is reviewed, and refunded to the driver's wallet if the review finds the ride did not take place.

8. Cancellations, no-shows and disputes

Either party may raise a dispute about a journey through the app. The Operator reviews disputes and decides the outcome, which may include refunding held commission or recording a strike against a passenger or driver. Our decision on commission and account standing is final, without affecting your legal rights.

9. Acceptable use

You must not misuse the Service, including: providing false information; using it for anything unlawful; harassing or endangering others; attempting to bypass the Operator to avoid commission; interfering with the apps or our systems; or submitting false quotes or bookings.

10. Ratings and content

Ratings and feedback must be honest and lawful. We may remove content that is abusive, false or unlawful. Drivers do not see a passenger's name when bidding, and certain details are hidden to protect privacy.

11. Our liability

Because we arrange bookings rather than provide the journey, the driver is responsible for the transport and for their vehicle, conduct and insurance. We provide the booking platform "as is" and do not guarantee that a driver will be available for any request, or that the app will be uninterrupted or error-free.

To the extent permitted by law, we are not liable for the acts or omissions of drivers or passengers, or for loss arising from a journey itself. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law — including liability for death or personal injury caused by negligence, or for fraud.

12. Suspension and closing your account

We may suspend or restrict an account that breaches these terms or the law, or to protect safety. Passengers can delete their account in the app at any time. Drivers can request account closure in the Driver app; we will offboard them and delete or anonymise data we are not legally required to keep (see the Privacy Policy).

13. Changes

We may update these terms from time to time. The "last updated" date shows the current version, and significant changes will be notified in the app. Continuing to use the Service means you accept the updated terms.

14. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
